1. Agreement to these Terms
Welcome to SIXBYTE. These Terms of Service ("Terms") govern your access to and use of the SIXBYTE website, portfolio hosting platform, account services, applications, features and related services (collectively, the "Service"). "SIXBYTE", "we", "us" and "our" refer to the operator of the Service.
By creating an account, uploading content, publishing a portfolio or otherwise using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
2. About SIXBYTE
SIXBYTE provides tools that allow users to create accounts, upload portfolio website files, publish and share portfolio websites, manage portfolio information and use related hosting features. Features may be added, changed or removed as the Service develops.
Where a material change significantly affects existing users, we will take reasonable steps to provide notice where appropriate.
3. Eligibility
You must be legally capable of entering into an agreement to use SIXBYTE. If you are under 18, you should use the Service only with the permission of a parent or legal guardian where required by applicable law.
By using SIXBYTE, you confirm that the information you provide is accurate and that your use complies with applicable law.
4. Accounts and account security
Some features require a registered account. You agree to:
- provide accurate and reasonably current account information;
- maintain a valid email address;
- keep your password and authentication credentials confidential;
- take reasonable steps to prevent unauthorised access to your account; and
- notify SIXBYTE if you believe your account has been compromised.
You are responsible for activity performed through your account to the extent that the activity results from your actions or a failure to take reasonable account-security precautions.
5. Your content and ownership
"User Content" includes portfolio websites, HTML, CSS, JavaScript, source code, ZIP archives, images, graphics, videos, resumes, documents, project descriptions, profile information and any other material you upload, create, store or publish through SIXBYTE.
You keep ownership
You retain ownership of your original User Content. Uploading content to SIXBYTE does not transfer ownership of your portfolio, code, designs, images or other original material to us.
Licence needed to provide the Service
By uploading or publishing User Content, you grant SIXBYTE a limited, non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, transmit and display that content only as reasonably necessary to provide, secure and operate the Service. This includes storing files, serving published portfolios, creating technical backups, processing files for delivery and detecting harmful content.
This licence ends when the relevant content is permanently deleted from our systems, except where copies temporarily remain in backups, logs or records for legitimate security, legal, fraud-prevention or technical purposes.
6. Responsibility for User Content
You are responsible for ensuring you have the rights and permissions needed to upload and publish your content.
You must not use SIXBYTE to upload, host or distribute content that:
- infringes copyright, trademarks or other intellectual property rights;
- contains malware, ransomware, spyware, viruses or other intentionally harmful code;
- operates phishing pages or is designed to steal credentials;
- facilitates fraud, scams or unlawful impersonation;
- unlawfully exposes confidential or private information;
- contains child sexual exploitation or abuse material;
- makes credible threats of serious violence or directly facilitates serious unlawful harm; or
- otherwise violates applicable law or creates a serious security risk.
7. Cybersecurity and educational projects
SIXBYTE recognises that legitimate portfolios may discuss cybersecurity, ethical hacking, penetration testing, digital forensics, networking, malware analysis and security research. Educational or professional security content is not prohibited merely because it demonstrates security concepts.
SIXBYTE must not, however, be used to attack systems without authorisation, operate phishing infrastructure, distribute active malicious payloads, steal credentials, control compromised devices or conduct other unlawful cyber activity.
8. Acceptable use
You must not misuse or intentionally interfere with the Service. You must not:
- attempt to access another user's account without authorisation;
- conduct denial-of-service attacks or deliberately overload SIXBYTE infrastructure;
- bypass access controls or exploit vulnerabilities for harmful purposes;
- use the Service to distribute spam, phishing or malicious code;
- scrape personal information unlawfully;
- use automated systems in a way that materially disrupts the Service; or
- falsely claim that you represent or are endorsed by SIXBYTE.
Reasonable use of development, accessibility, search-engine and authorised testing tools is allowed where it does not materially interfere with the Service.
9. Public portfolios
When you publish a portfolio publicly, information in that portfolio may be accessible to anyone on the internet and may be indexed, shared or copied by third parties. You should review your portfolio carefully before publishing and avoid including passwords, private keys, identification documents, confidential data or information you do not want publicly available.
10. Backups and data availability
SIXBYTE may maintain technical backups, but the Service is not intended to be your only backup system. Keep independent copies of important portfolio files, code, images and documents. We do not guarantee that deleted, corrupted or lost files can always be recovered.
11. Service availability and maintenance
We aim to provide a reliable Service, but uninterrupted availability cannot be guaranteed. SIXBYTE may be unavailable because of maintenance, software updates, security work, hosting or database failures, internet outages, cyber incidents or circumstances outside our reasonable control.
12. Content review, suspension and removal
We may investigate content or account activity where we reasonably believe these Terms or applicable law may have been violated, a legitimate complaint has been received, or action is required to protect users, third parties or the Service.
Depending on the circumstances, we may issue a warning, restrict access to content, temporarily disable a portfolio, remove specific content, suspend an account or terminate an account. Where reasonable and legally permitted, we will consider the seriousness of the issue before permanent action is taken.
Immediate action may be taken where reasonably necessary to address active malware, phishing, child sexual exploitation material, serious unlawful content, cybersecurity threats or binding legal requirements.
13. Intellectual property and complaints
SIXBYTE respects intellectual property rights. If you believe material hosted through SIXBYTE infringes your rights, contact legal@sixbyte.io and include your contact details, identification of the protected work, the relevant SIXBYTE URL and an explanation of the alleged infringement.
14. Security and vulnerability reporting
We use reasonable technical and organisational measures designed to protect the Service, but no internet-connected system can guarantee absolute security. If you identify a potential vulnerability, report it responsibly to security@sixbyte.io.
Do not access unnecessary user information, destroy or alter data, conduct denial-of-service testing or exploit a vulnerability beyond what is reasonably necessary to demonstrate and report it.
15. Third-party services
SIXBYTE may rely on third-party providers for authentication, databases, hosting, object storage, content delivery, email, analytics, cybersecurity, domains and other infrastructure. Those providers may have their own terms and privacy practices. SIXBYTE is not responsible for the independent content or practices of third-party websites linked from user portfolios or the Service.
16. Service communications
We may send necessary operational messages including email verification, password resets, security alerts, account notices and important policy or service communications. Optional marketing communications, if introduced, will be handled separately and will include appropriate choices where required by law.
17. Free and paid services
SIXBYTE offers a free plan and may offer paid subscription plans. Prices, included features, billing periods and any applicable taxes are shown before purchase. Paid subscriptions renew automatically for the selected billing period until cancelled, unless the checkout terms state otherwise.
Payments are processed by a third-party payment provider. Users can cancel or manage an active subscription through the billing tools made available by SIXBYTE. Cancellation normally prevents the next renewal while paid access continues until the end of the already-paid billing period, subject to applicable law. Nothing in this section limits rights or remedies that cannot be excluded under the Australian Consumer Law.
18. Australian Consumer Law
Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation. Where mandatory consumer protections apply, those protections prevail over an inconsistent provision in these Terms.
19. Disclaimers
To the maximum extent permitted by law, SIXBYTE is provided on an "as available" basis. We do not guarantee that every feature will always be available, the Service will be uninterrupted or error-free, every uploaded portfolio will work correctly, files will always be recoverable or third-party services will remain available.
Nothing in this section excludes guarantees, warranties or rights that cannot legally be excluded.
20. Limitation of liability
To the maximum extent permitted by applicable law, SIXBYTE is not responsible for indirect or consequential loss caused solely by circumstances outside our reasonable control, including third-party infrastructure failures, internet outages, a user's failure to maintain backups or content uploaded by another user.
This section does not exclude or limit liability where doing so would be prohibited by law.
21. Closing, suspending or terminating accounts
You may stop using SIXBYTE at any time and may use available account-deletion functionality or request deletion. We may suspend or terminate an account where the user seriously or repeatedly violates these Terms, uses the account for serious unlawful activity, creates an ongoing security threat, or where we are legally required to act.
After deletion, some information may temporarily remain in backups, security logs or records where reasonably required for legal, security, fraud-prevention or technical purposes.
22. Changes to the Service and these Terms
We may update the Service and these Terms to introduce features, improve security, comply with law or clarify existing provisions. If a change materially affects user rights or obligations, we will take reasonable steps to provide notice before the change takes effect where practicable.
23. Governing law
These Terms are governed by the laws of Victoria, Australia and applicable Commonwealth laws of Australia. Nothing in this section removes a right you may have under applicable law to bring a claim in another jurisdiction.
24. General provisions
If any provision of these Terms is invalid or unenforceable, it will be interpreted or removed only to the minimum extent necessary and the remaining provisions will continue to apply. A delay in enforcing a provision does not permanently waive the right to enforce it later.
These Terms, together with the Privacy Policy, Cookie Policy and any additional terms presented for a specific service, form the agreement governing your use of SIXBYTE.
